Terms & Conditions

Please Read The Following Carefully Before Ordering

Orders are accepted and promises for delivery given conditionally upon our being able to secure the necessary goods and without responsibility for delays arising through unforeseen manufacturing delays, strikes, accidents or other causes beyond our control. Modelli Fabrics will take all reasonable steps to advise customers of potential delays as soon as possible after an order is placed.

All risks in the goods shall pass to the customer on delivery, but the goods shall remain the property of Modelli Fabrics until paid for in full by the customer.

All care and attention is given to ensure that the technical information and advice is accurate but the seller does not warrant the accuracy thereof and the customer relies on the same at his own risk.

No goods can be released to customers until paid for in full.

Prices are subject to change.

All business is subject to our terms and conditions of business.

All prices on the website include VAT at the current rate applicable. The VAT amount is displayed on the final order page. We abide by the code of practice covering the use of personal data as outlined in the Data Protection Act of 1998.

All shipments outside of the UK are sent DDP, meaning there are no surprise local duties and taxes to pay*. *Customers ordering goods to the US are responsible for any local taxes and/or duties incurred.

Ordering

Customers can either make payment through our website or by phone on 01949 851 116 - however our phones can be extremely busy so in order to avoid frustration we always recommend clients to order online wherever possible.

If paying online, customers will be taken to Sage Pay for payment after the order has been placed on our site. This is a specialist external site which offers extremely secure payment processing and is fully certified accordingly. When payments are made via Sage Pay, monies are held in escrow and are only drawn down by Modelli once goods are shipped.

If paying by phone, customers should be aware that although payment is done via Sage Pay by us on their behalf, monies are taken at point of payment and not when goods are shipped. This is because we do not have, nor would ever ask for, personal password details which clients need to enter when paying online. Because we skip this step in the process payment is immediate. We can however reassure customers that paying by phone is just as secure as paying online.

If customers order fabric to be sent direct to their upholsterer/curtain maker etc, then the onus is on the customer to ensure that the person doing the work has a sample to check against fabric sent to them. Whilst we make every effort to eliminate mistakes on our side, it can happen very rarely that the wrong fabric, for whatever reason, is shipped in error. It is therefore imperative that bulk fabric deliveries are properly checked before processing. We will not entertain any claims stemming from a failure to follow this advice but we will happily replace any orders where an error has occurred on our part.

Issues & Complaints

Fabric should be inspected as soon as possible after delivery. If there are any issues involving damage in transit, unmarked flaws or other damage then customers need to inform us within 7 working days of receipt. No complaints will be entertained once 7 working days have elapsed.
